Terms and Conditions of Purchase

These Terms and Conditions govern the purchase of products through the website www.wemasai.com, owned by Helena Pérez de Avilés Molina. By placing an order, the customer fully accepts these conditions.

2. Products

WEMASAI offers clothing, accessories, decorative items, and tableware from Africa through its website.

We strive to present our products as accurately as possible. However, colors or details may vary slightly depending on the device used to view them. Handmade pieces may show slight variations inherent to their nature, which form part of their value and authenticity.

 

3. Purchase Process

The purchase process is carried out through the following steps:

  1. Product selection.
  2. Add product to cart.
  3. Enter shipping and billing information.
  4. Select payment method.
  5. Order confirmation.
  6. Order confirmation and payment.

The sales contract is concluded at the moment WEMASAI sends the customer the order confirmation by email. This confirmation will include the order summary, the total amount, and the shipping details.

WEMASAI reserves the right to reject or cancel an order in the event of a pricing error, lack of stock, or indications of fraudulent use, informing the customer accordingly and proceeding with a full refund if payment has already been made.

 

4. Prices

All prices shown on the website are in euros (€) and include the applicable VAT in accordance with current legislation, unless expressly stated otherwise.

Shipping costs are not included in the product price and will be shown separately before completing the purchase process.

WEMASAI reserves the right to modify prices at any time. Any changes will not affect orders that have already been confirmed.

 

5. Payment Methods

The customer may make payment using the following methods available on the website:

  • Credit or debit card (Visa, Mastercard, and other accepted networks)
  • Bizum
  • Other methods available at the time of purchase

Payments are processed through secure payment platforms with SSL encryption. WEMASAI does not store bank card details. If the financial institution does not authorize the payment, the order will be automatically cancelled.

 

6. Order cancellation

The customer may cancel the order provided that it has not yet been prepared or shipped. To do so, they must contact WEMASAI as soon as possible at hola@wemasai.com or by phone at +34 616 48 98 92, stating the order number.

If the order has already been shipped, it will no longer be possible to cancel it, but the customer may exercise their right of withdrawal once the product has been received, as indicated in section 8 of these terms.

If the cancellation is accepted before shipment, a full refund of the amount paid will be issued within a maximum period of 14 calendar days. This period will depend on the banking institution, and the refund will be made using the same payment method used for the purchase.

 

7. Shipping

WEMASAI ships to mainland Spain, the Balearic Islands and Europe. Shipping times and costs are detailed in our Shipping Policy.

Delivery times are indicative and may be affected by circumstances beyond WEMASAI’s control, such as logistical incidents, public holidays, or force majeure. Under no circumstances shall WEMASAI be held responsible for delays attributable to the carrier.

The risk of loss of or damage to the products passes to the customer at the time of physical delivery of the order.

 

8. Right of withdrawal

In accordance with Royal Legislative Decree 1/2007 of 16 November (TRLGDCU), the customer has a period of 14 calendar days from receipt of the product to exercise the right of withdrawal, without the need for justification and without any penalty.

To exercise this right, the customer must notify WEMASAI before the expiry of that period by means of an unequivocal written communication sent to hola@wemasai.com, indicating the order number and the products they wish to return.

After this communication, the customer will have an additional 14 calendar days to return the product. Return costs shall be borne by the customer, unless WEMASAI states otherwise.

The refund will be made within a maximum period of 14 calendar days from receipt of the returned product, using the same payment method used for the purchase. WEMASAI may withhold the refund until it has received the product or until the customer provides proof of its return.

Excluded from the right of withdrawal are personalised products, sealed products that cannot be returned for reasons of hygiene or health protection once opened, and products which, by their nature, have been inseparably mixed with other products after delivery.

10. Legal guarantee

All products sold by WEMASAI are subject to the legal guarantee of conformity provided for under the TRLGDCU. The legal guarantee period is 3 years from the delivery of the product, in accordance with current Spanish legislation.

 

11. Data protection

The personal data provided during the purchase process will be processed in accordance with the website’s Privacy Policy, pursuant to Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).

 

12. Online dispute resolution

In accordance with Regulation (EU) No. 524/2013, the European Commission provides consumers with an online dispute resolution platform, available at: https://ec.europa.eu/consumers/odr

 

13. Applicable law and jurisdiction

These terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the courts and tribunals of the consumer’s place of residence, in accordance with Royal Legislative Decree 1/2007 of 16 November.
